ARTICLE 3 – APPLICABILITY
3.1 These Terms & Conditions apply to every offer we make and to every Agreement concluded between you and us.
3.2 Before the Agreement is concluded, these Terms & Conditions are made available on our website. We also send them to you by email together with your order confirmation, so you can store them on a durable medium.
3.3 If any provision of these Terms & Conditions is invalid or void, the remaining provisions stay in full force. The invalid provision will be replaced by a provision that comes as close as possible to the original intention.
3.4 Nothing in these Terms & Conditions limits your mandatory statutory rights as a Consumer.
ARTICLE 4 – THE OFFER
4.1 All offers on our website are without obligation and valid while stocks last.
4.2 Each offer contains a complete and accurate description of the products. Images are a true representation of the products, but small differences in colour or appearance are possible.
4.3 Obvious mistakes or errors in the offer (for example, an obviously incorrect price) do not bind us.
4.4 Each offer clearly states the price, any delivery costs, the payment methods and how the Agreement will be carried out.
ARTICLE 5 – THE AGREEMENT
5.1 The Agreement is concluded when you complete the checkout process and we send you an order confirmation by email.
5.2 Until we have confirmed receipt of your order, you can cancel it free of charge.
5.3 We take appropriate technical and organisational measures to secure the electronic transfer of data and provide a safe web environment. Payments are processed through secure payment providers.
5.4 We may refuse or cancel an order if there are justified reasons. Examples are suspected fraud, an obvious pricing error, or a product that is no longer available. If we do so, we will inform you and refund any payment within 14 days.
ARTICLE 6 – PRICES
6.1 All prices on our website are in euros (EUR) and include Dutch VAT (BTW), unless stated otherwise.
6.2 Shipping costs are shown separately at checkout before you complete your order.
6.3 Prices will not increase during the validity period stated in the offer, except for price changes caused by changes in VAT rates.
6.4 If we show a price reduction, the reference price is the lowest price we charged for that product in the 30 days before the reduction.
ARTICLE 7 – PAYMENT
7.1 You can pay using the payment methods shown at checkout.
7.2 Consumers cannot be obliged to pay more than 50% of the purchase price in advance. If full advance payment has been agreed, the Consumer cannot claim any rights regarding the execution of the order until the agreed advance payment has been made.
7.3 You must report any inaccuracies in the payment details provided or stated to us without delay.
7.4 If payment fails or is reversed, we may suspend delivery until payment has been received.
ARTICLE 8 – DELIVERY
8.1 We deliver to the address you provide during checkout. You are responsible for providing a correct and complete delivery address.
8.2 We process accepted orders without undue delay, and no later than 30 days after the order, unless a longer delivery period has been agreed. Estimated delivery times are listed in our Shipping Policy.
8.3 If delivery is delayed, or an order cannot be (fully) fulfilled, we will inform you within 30 days of your order. In that case you may cancel the Agreement free of charge, and we will refund any amount paid within 14 days.
8.4 The risk of loss of or damage to products remains with us until the products are delivered to you, or to a third party designated by you in advance (other than the carrier).
ARTICLE 9 – RIGHT OF WITHDRAWAL
9.1 As a Consumer, you may cancel the Agreement within 14 days without giving any reason.
9.2 The reflection period starts on the day after you, or a third party designated by you (other than the carrier), receive the product. If one order contains several products delivered separately, the period starts on the day after you receive the last product.
9.3 More information about withdrawal is available in our Return & Refund Policy.
ARTICLE 10 – YOUR OBLIGATIONS DURING THE REFLECTION PERIOD
10.1 During the reflection period, handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to determine its nature, characteristics and functioning, as you would in a physical store.
10.2 You are liable for any diminished value of the product that results from handling it beyond what is described in Article 10.1.
ARTICLE 11 – EXERCISING THE RIGHT OF WITHDRAWAL AND COSTS
11.1 To withdraw, notify us within the reflection period by email at support@tiiczw.com. You can use the Model Withdrawal Form on our website or send any other clear statement. You can also withdraw online via the "Withdraw from contract here" button, which is available in the footer of every page of our website.
11.2 As soon as possible, and no later than 14 days after your notification, return the product to the return address we provide. The deadline is met if you send the product back before the 14-day period has expired.
11.3 Return the product with all accessories supplied, in its original condition and packaging where reasonably possible, and follow our reasonable return instructions.
11.4 The risk and burden of proof for correct and timely withdrawal are on you. We recommend using a traceable shipping method.
11.5 You pay the direct costs of returning the product, unless the product is defective or we sent you the wrong product.
ARTICLE 12 – OUR OBLIGATIONS IF YOU WITHDRAW
12.1 We will confirm receipt of your withdrawal notification by email without delay. If you use the online withdrawal function, this acknowledgement of receipt will state the content of your withdrawal and the date and time it was received.
12.2 We will refund all payments, including the standard delivery costs we charged for the original order, without undue delay and no later than 14 days after you notified us of your withdrawal. We may wait to refund until we have received the product back, or until you show proof that you have sent it back, whichever is earlier.
12.3 We refund using the same payment method you used, unless you agree to another method. The refund is free of charge for you.
12.4 If you chose a more expensive delivery method than our cheapest standard delivery, we do not have to refund the additional costs.
ARTICLE 13 – EXCLUSION OF THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:
• products made to your specifications or clearly personalised;
• products that spoil quickly or have a limited shelf life;
• sealed products that are not suitable for return for reasons of health protection or hygiene, once the seal has been broken after delivery;
• products that, after delivery, are by their nature inseparably mixed with other items;
• sealed audio or video recordings and computer software, once the seal has been broken after delivery.
Where a product falls under one of these exceptions, we will state this clearly in the product description before you order.
ARTICLE 14 – CONFORMITY AND STATUTORY WARRANTY
14.1 We guarantee that our products conform to the Agreement, the specifications stated in the offer, and the reasonable requirements of soundness and usability. This is your statutory warranty (legal guarantee) under Dutch law.
14.2 If a defect appears within one year of delivery, it is presumed that the product did not conform to the Agreement at the time of delivery, unless we prove otherwise.
14.3 If a product is not in conformity, you are entitled to repair or replacement free of charge. If that is not possible or reasonable, you are entitled to a price reduction or a full refund.
14.4 Please inform us within a reasonable time after you discover a defect. Notification within two months of discovery is always considered timely.
14.5 Any additional warranty offered by us or a manufacturer never limits your statutory rights.
14.6 The statutory warranty does not cover damage caused by improper use, normal wear and tear, accidents, or failure to follow the instructions for use.
ARTICLE 15 – COMPLAINTS
15.1 Please send complaints about the performance of the Agreement to support@tiiczw.com, fully and clearly described, within a reasonable time after you discover the issue.
15.2 We will reply to complaints within 14 days of receipt. If a complaint requires more time, we will confirm receipt within 14 days and tell you when you can expect a full answer.
15.3 We will always try to find a solution together with you first.
ARTICLE 16 – LIABILITY
16.1 Our liability is limited to the amount paid for the relevant order, except in cases of intent or gross negligence on our part.
16.2 We are not liable for indirect damage, such as consequential loss or loss of profit, except in cases of intent or gross negligence.
16.3 This article does not limit your mandatory statutory rights as a Consumer, including your rights under the statutory warranty and product liability law.
ARTICLE 17 – FORCE MAJEURE
We are not liable for failure or delay in performing our obligations caused by circumstances beyond our reasonable control. Examples include natural disasters, pandemics, strikes, carrier disruptions, customs delays, war or government measures. If the force majeure situation lasts longer than 30 days, both you and we may cancel the Agreement. In that case, any amount already paid for undelivered products will be refunded.
ARTICLE 18 – INTELLECTUAL PROPERTY
All texts, images, logos, designs and other content on our website are owned by Nose Trading B.V. or its licensors. They may not be used, copied or distributed without our prior written permission.
ARTICLE 19 – PERSONAL DATA
We process your personal data in accordance with the General Data Protection Regulation (GDPR). For more information, please read our Privacy Policy.
ARTICLE 20 – BUSINESS CUSTOMERS
If you order as a business (not as a Consumer), the right of withdrawal (Articles 9 to 13) does not apply. To the extent permitted by law, our total liability towards business customers is limited to the invoice amount of the order concerned.
ARTICLE 21 – CHANGES TO THESE TERMS
We may change these Terms & Conditions from time to time. The version published on our website at the time of your order applies to your order.
ARTICLE 22 – APPLICABLE LAW AND DISPUTES
22.1 These Terms & Conditions and all Agreements are governed by Dutch law. If you are a Consumer living in another EU country, you keep the protection of the mandatory consumer law of your country of residence.
22.2 We will always try to resolve disputes amicably first. If that is not possible, the dispute will be submitted to the competent court in the Netherlands, without prejudice to your right as a Consumer to bring proceedings before the competent court of your place of residence.
22.3 We are not a member of an alternative dispute resolution body and are not obliged to participate in alternative dispute resolution. Consumers in the EU may contact the European Consumer Centre (ECC) in their country for information and assistance.
